What does a German Arbeitszeugnis really say, and what does the decoding cost?

Almost never what it seems to say. German employers must write references that are truthful and benevolent at the same time, so the market developed a standard code: "stets zur vollsten Zufriedenheit" is a top grade, while "zur vollen Zufriedenheit" sounds nearly identical and is a mediocre one. Why the language is coded

Every employee in Germany is entitled to a written reference under § 109 GewO. The same law demands clear, comprehensible wording and forbids hidden marks. Court rulings add a second duty: the text must be benevolent, it may not block your future career.

Truthful and kind at once is a contradiction, and the German HR world resolved it with a scale. Nobody writes "average performer". They write "zur vollen Zufriedenheit" and every recruiter in the country knows the translation. Criticism moved into gradations, word order and, above all, omissions. If your German is not native, you are reading the document exactly the way it was designed to be misread.

The satisfaction scale

The core grade hides in one sentence, usually near the end of the performance section:

One missing word, one full grade. And the scale is only the entry ticket: the sharper messages sit in what the Zeugnis does not say.

What a pharma recruiter reads first

I read these documents for 14 years on the hiring side of pharma, the most recent 9 of them at Bayer and the 5 before that inside two of the Global Top 3 CROs. The satisfaction formula took me three seconds. The rest of the time went into passages most checklists skip.

The activity description is the loudest. If you ran submissions, sat in audits, led a team of six and held a budget, and the Zeugnis lists generic project support, that reads as a quiet demotion, whatever the grade says. In pharma the scope signals are specific: which GxP areas, which systems, which study phases, team size, budget. Their absence costs interviews.

Then the conduct sentence, where the conventional order names supervisors first, and any deviation or omission is deliberate. Then the closing formula: thanks for the cooperation, regret at the departure, good wishes for the future. There is no legal entitlement to it, employers know that, and leaving it out is one of the few sanctioned ways to be loud. And always the gaps: a soft skill praised where a core competence should stand, a responsibility that appears in your CV but not in your reference.

The legal frame, briefly

§ 109 GewO gives you the right to a reference that covers performance and conduct, in clear wording, without hidden marks. Case law adds the duty of benevolence. The Federal Labour Court settled the burden of proof in 2014 (9 AZR 584/13): "zur vollen Zufriedenheit" is the average, and an employee who wants a better grade has to prove the facts that justify it. Where an employer grades below average, separate settled case law puts the burden on the employer. And there is no entitlement to the closing formula (BAG, 9 AZR 227/11), which is precisely why everyone notices when it is missing. What does "zur vollen Zufriedenheit" actually mean?

It translates as "to our full satisfaction" and sounds excellent. In Zeugnis code it is a grade 3, satisfactory at best. The top grade is "stets zur vollsten Zufriedenheit". One missing word moves you a full grade, which is exactly why face-value reading is dangerous for non-native speakers.

Am I entitled to a good Arbeitszeugnis under German law?

You are entitled to a truthful and benevolently worded reference under § 109 GewO. The Federal Labour Court ruled on 18 November 2014 (9 AZR 584/13) that "zur vollen Zufriedenheit" marks the average, and that an employee who wants a better final grade has to plead and prove the facts justifying it. The reverse case, an employer grading below average, rests on separate settled case law under which the employer carries the burden. There is also no legal entitlement to the closing thanks-and-good-wishes formula (BAG, 11 December 2012, 9 AZR 227/11), which is why its absence is such a loud signal.

Is this legal advice?
